GDPR CHARTER – PERSONAL DATA

The Agence locale pour l’Emploi [Local Employment Agency] for the City of Brussels (ALE Bxl), with its registered address boulevard d’Anvers, 26, 1000 Brussels, and registered in the BCE [Belgian Companies Register] under number 0459.282.132, in its capacity as data controller, pays particular attention to the protection of your personal data and the protection of privacy, and consequently undertakes to take all reasonable precautions required to protect the personal data collected against loss, theft, disclosure or unauthorised use.

This Charter aims to provide information on the way in which the Agence locale pour l’Emploi for the City of Brussels processes, uses and protects personal data that you have supplied to it when using its services.

Toute donnée à caractère personnel collectée par l’Agence locale pour l’Emploi de la Ville de Bruxelles sera transférée, stockée et traitée dans le respect de la Loi du 30 juillet 2018, relative à la protection des personnes physiques à l’égard des traitements de données à caractère personnel, et du Règlement (UE) 2016/679 du Parlement européen et du Conseil du 27 avril 2016 relatif à la protection des personnes physiques à l’égard du traitement des données à caractère personnel et à la libre circulation de ces données, et abrogeant la directive 95/46/CE.

1. What personal data is collected?

Within the context of the activities constituting its corporate objective, the Agence locale pour l’Emploi for the City of Brussels may be required to collect information about you, including your last names, first names, address, telephone numbers, fax or mobile numbers, email address, VAT number, etc. This information is collected exclusively for the sole impartial purpose of properly performing its duties in relation to the corporate objective and to be able to satisfy the accounting and invoicing obligations.

You make a commitment to ensure that the data communicated to the Agence locale pour l’Emploi for the City of Brussels is correct and truthful. The Agence locale pour l’Emploi for the City of Brussels does not accept any liability in the event of losses incurred as a result of the supply of false, incomplete or fraudulent information.

Non-personal data collected, from which an individual cannot be identified either directly or indirectly, is considered to be out of the scope of application of this Charter.

2. Purposes of processing your data

The Agence locale pour l’Emploi [Local Employment Agency] for the City of Brussels uses your personal data for the following purposes only:

  • Contractual registration as ALE worker and user of ALE services and Service vouchers
  • Execution of ALE and Service voucher services,
  • Communication of information regarding contractual registration and performance of services,
  • Invoicing and receipt of payments for sales and services,
  • Accounting,
  • Responding to questions and requests that you have made to the agency,
  • Satisfaction surveys and information via mailshots, either physical or virtual, regarding the services provided by the Agence locale pour l’Emploi for the City of Brussels,
  • Notification in the event of a personal data breach or leak when this leak is likely to cause an increased risk to your rights and freedoms,
  • Distribution of new versions of this Charter whenever it is updated.

3. Storage period for your personal data

The Agence locale pour l’Emploi for the City of Brussels only keeps personal data for the time reasonably required for the intended purpose and in accordance with legal and regulatory requirements.

Invoices and accounting data is stored for a period of 10 years.

The Agence locale pour l’Emploi for the City of Brussels undertakes to respond within a reasonable time frame to any request relating to the exercising of the aforementioned rights. This time frame cannot exceed one (1) month from receipt of the request, unless the Agence locale pour l’Emploi for the City of Brussels decides to exercise its right to extend the time frame which will be a maximum of two (2) months.

5. How is your personal data protected/secured?

The Agence locale pour l’Emploi for the City of Brussels implements all appropriate technical and organisational measures to ensure an adequate level of security for the data collected and the processing thereof given the nature of the data to be protected and the risk related to processing such data. The protection/safeguarding measures put in place take account of the knowledge status, costs of implementation and nature, scope, context and purposes of processing the data as well as the risks for your rights and freedoms.

The data collected is not disclosed to third parties without prior consent on your part, unless necessary to respond to your requests, or if the Agence locale pour l’Emploi for the City of Brussels is legally obliged to do so.

8. Applicable law and court having jurisdiction

This Charter is governed by Belgian law.

Any disputes relating to the interpretation or execution of this Charter are subject to Belgian law and only the sections of the courts or magistrates court in which the registered office of the Agence locale pour l’Emploi for the City of Brussels is located shall have jurisdiction.
